Terms & conditions

These Terms govern the relationship between PAYMETER IBÉRICA, S.L. ("Paymeter") and the User of the service in Spain. Please read before registering.

1. Purpose and acceptance

Paymeter provides an electronic service to manage vehicle parking in regulated zones and partner garages, as well as ancillary services (wallet, fine payment, reservations). Registration and use imply full acceptance of these Terms, the Legal Notice, and the Privacy Policy.

2. User account and requirements

  • Be at least 18 years old (14-17 with express written parental consent).
  • Have a smartphone with an active number registered in the User's name.
  • Link at least one card or bank account in the User's name.
  • Provide accurate, current, and truthful data. One phone = one account.

3. Account suspension and termination

Paymeter may suspend or terminate the account, with prior notice where feasible, in the following cases:

  • False data or identity impersonation.
  • Fraudulent or unlawful use of the Service.
  • Non-payment after demand.
  • More than 3 consecutive declined charges.
  • Sharing credentials with third parties.
  • Bots, scraping, or unauthorized automated use.
  • Material breach of these Terms.

4. How the Service works

The User starts and ends a parking session from the Application. The amount is calculated by actual time and the rate published by the operator or municipality. In LPR garages, entry/exit is detected by license-plate recognition (low-risk automated process, compatible with AI Act Regulation (EU) 2024/1689). Paymeter is not a payment service within PSD2/PSD3; payments are processed by authorized third-party providers.

5. Price, fees and invoicing

Applicable prices are those displayed in the Application at the start of each session. Invoices are issued electronically and available in the User's account. Currency: €.

6. Right of withdrawal (14 calendar days)

Pursuant to applicable consumer law, you have 14 calendar days from the contract to withdraw without penalty. However, by starting a parking session with your express consent, you acknowledge that you lose the right of withdrawal for that specific service once executed.

7. Complaints (60-day window)

Any disagreement with a charge or service must be reported to sat@paymeter.io within 60 days of the start of the service or the charge. We will acknowledge and resolve within statutory deadlines.

8. Limitation of liability

Without prejudice to mandatory consumer rights, Paymeter's aggregate liability shall not exceed 5.000 € per user per year, except in cases of willful misconduct or gross negligence, or where applicable law prohibits such limitation. Paymeter is not responsible for: (i) traffic fines attributable to the User, (ii) parking-operator failures outside Paymeter's control, (iii) telecommunications outages, (iv) misuse by third parties.

9. Force majeure

Neither party shall be liable for breaches arising from causes beyond reasonable control, including: fire, flood or other natural disasters, epidemics or pandemics, acts of war or terrorism, labor disputes, widespread internet or telephone-network failures, cyberattacks, general traffic restrictions, legislative or governmental decisions.

10. Indemnification

The User shall indemnify Paymeter, its affiliates, and employees against any third-party claim arising from the User's misuse of the Service.

11. Intellectual property

Paymeter grants the User a personal, non-exclusive, non-transferable, territory-limited license. Reverse engineering, decompilation, or reproduction of the Application is prohibited.

13. Dispute resolution

Before going to court, consumer Users may turn to: (a) the National Consumer Arbitration Board (Spain); (b) the EU ODR platform: ec.europa.eu/consumers/odr; (c) Municipal Consumer Information Offices (OMIC). These channels are free and voluntary.

14. Applicable law and jurisdiction

These Terms are governed by Spanish law. The parties submit to Courts and tribunals of Spain, without prejudice to the consumer's forum.
