2. What Paymeter does
Paymeter is a mobile app and web platform for on-street regulated parking, LPR garage parking, spot reservations, mobility wallet, and fine payment. Aimed at residents in Spain or visitors to Spain.
3. Terms of use
Using Paymeter means you accept this Legal Notice, the Privacy Policy, and the General Terms of Service. If you disagree, do not use the service.
4. Intellectual property
All content (texts, images, audio, video, designs, source code, logos, trademarks) belongs to PAYMETER IBÉRICA, S.L. or licensed third parties and is legally protected. Reproduction, distribution, or exploitation without written authorization is prohibited.
5. Content moderation (DSA)
Paymeter is not a large-scale user-generated-content platform within the meaning of Regulation (EU) 2022/2065 (Digital Services Act — DSA). We nonetheless apply DSA principles to any user-contributed content (reviews, vehicle images, support tickets).
6. Paymeter is not a bank or payment institution
Paymeter is a technical information-society service provider. Its services are not payment services within PSD2 (Directive 2015/2366/EU) or the proposed PSD3/PSR1. Payments are processed by authorized third-party providers under their own banking regulation. When PSD3/PSR1 enters into force, Paymeter will review its regulatory position.
7. Digital operational resilience
Paymeter applies digital operational resilience measures aligned with Regulation (EU) 2022/2554 (DORA) principles — ICT risk management, business continuity, and incident response — even though DORA applies directly to financial entities and their critical ICT providers.
8. Automated decision-making
Some Paymeter functions (fraud detection, license-plate verification, dynamic pricing) use automated processes. No decision with significant legal effect on the User is taken exclusively by automated means without available human review, consistent with Regulation (EU) 2024/1689 (AI Act) for low-risk AI systems.
9. Liability
Paymeter does not guarantee uninterrupted availability and is not liable for: (i) unavailability or inaccessibility, (ii) technical or network interruptions, (iii) unauthorized third-party access, (iv) viruses or harmful elements from third parties.
Paymeter's aggregate liability shall not exceed 5.000 € per user per year, except in cases of willful misconduct or gross negligence, or where applicable law prohibits such limitation.
10. Applicable law and jurisdiction
This relationship is governed by Spanish law. The parties submit to Courts and tribunals of Spain, without prejudice to the consumer's forum where applicable.
